A Few Maryland Basics Worth Knowing

- Divorce grounds changed in 2023. Since October 1, 2023, Maryland no longer has “limited divorce.” An absolute divorce can be based on six months of separation, irreconcilable differences, or mutual consent with a signed settlement agreement.
- Carroll County cases go to the Circuit Court in Westminster, which handles family law matters.
- The family home has special rules. A Maryland court can give one spouse “use and possession” of the family home for a period after the divorce, generally ending no later than three years after the final decree. When that period ends, the court can make further decisions about the home as marital property.
